Terms of Service
Effective October 19, 2026
OtterReel is operated by Webgophers, Inc. ("we", "us"). These Terms of Service ("Terms") are a binding agreement between you and us for your use of OtterReel, including the website, the videos, staged photos, descriptions and captions it makes (the "Output"), and any related services (together, the "Service"). You must accept these Terms before you use the Service. If you use it for a brokerage or team, you confirm you are allowed to accept them for that business too. Please also read our Privacy Policy. Questions: support@webgophers.com.
Please read section 15: it says disputes are settled by individual arbitration, not in court or in a class action.
1. Who can use OtterReel
You must be at least 18 and invited by a team admin. You are responsible for keeping your Google account secure and for everything done with your sign-in. Tell us right away at support@webgophers.com if you think someone else has used it.
2. A marketing tool, not professional advice
OtterReel is a tool that helps you make marketing material. It is not a real estate broker, appraiser, inspector, lawyer or compliance service, and nothing it makes is legal, tax, appraisal or real estate advice. You are the licensed professional, and you alone decide what you publish.
3. You are responsible for checking everything before you publish it
The Output is made partly by artificial intelligence and automated software. It can contain mistakes, including wrong room names, wrong prices, square footage, bed or bath counts, features the home doesn't have, misspelled names or addresses, wrong contact details, and staged photos that change the look of a room in ways you don't expect. Before you publish, post, upload or send any Output, you must review it and make sure it is accurate, complete and allowed. We are not responsible for any error in the Output, or for any loss that comes from publishing it.
4. MLS rules, listing data and the law
You are solely responsible for following every rule that applies to you, including:
- the rules of each MLS, listing service, portal and social platform you use (for example, rules on photos, video, branding, remarks and when listing content may be shared);
- your brokerage's policies and your license law, including advertising rules such as showing the brokerage name and your license details where required;
- the National Association of REALTORS® Code of Ethics, if you are a member;
- state and local laws on digitally altered listing images, such as California's AB 723.
OtterReel may copy facts and photos from a listing page or MLS feed you give it. We don't check that information and are not responsible if it is wrong, out of date or incomplete, or if you weren't allowed to use it. MLS information belongs to its owners; using OtterReel does not give you any extra right to it.
5. Virtually staged and altered photos
Virtual staging, day-to-dusk photos and other edits change what a photo shows. They are for illustration only and do not show the home as it really is. You agree to:
- clearly label every staged or altered photo and video as virtually staged or digitally altered, wherever and however your MLS, state law and the NAR Code of Ethics require (on the image itself where required);
- keep the original, unaltered photos available to buyers where required (OtterReel keeps your originals);
- never use staging to hide or misrepresent the condition of the property, such as covering damage, defects, stains, cracks, water marks, or changing walls, floors, fixtures, views or the room's size;
- check each staged photo yourself. OtterReel's automatic checks can miss problems, and a photo marked as passing may still be wrong.
6. Fair housing
You are solely responsible for making sure your marketing follows the federal Fair Housing Act and all state and local fair housing and anti-discrimination laws. Do not use OtterReel to make, edit or publish anything that shows a preference, limitation or discrimination based on race, color, religion, sex (including sexual orientation and gender identity), disability, familial status, national origin, or any other protected class under the law where the property is. This includes words in descriptions, captions and hashtags (for example, describing the ideal buyer or the neighborhood's people), and the choice of decor, people or neighborhood images. AI-written text can accidentally include wording that isn't allowed; reviewing it is your job, and we are not responsible for any fair housing claim, complaint or penalty that comes from your marketing.
7. Your content and permissions
"Your Content" is everything you or your team add: photos, listing links and facts, addresses, your details, contact cards, logos, music choices and notes. You keep ownership of Your Content. You promise that you have every right and permission needed to use it and to let us process it, including permission from the photographer (listing photos are often licensed only for certain uses), the seller, your brokerage and anyone shown in it. You give us a non-exclusive, worldwide, royalty-free license to store, copy, process, change and display Your Content only to run the Service for you, including sending it to the service providers listed in our Privacy Policy. We don't sell Your Content.
8. The Output
As between you and us, you may use the Output you make for your own marketing. Because AI is involved, similar Output may be made for others, and some Output may not be protected by copyright. Music, fonts and other material we supply are licensed to you only as part of the Output, not on their own.
9. Things you must not do
- Upload content you don't have the right to use, or content that is unlawful, misleading, hateful or explicit.
- Use OtterReel for property you aren't authorized to market, or to mislead buyers, sellers, renters or lenders.
- Share your sign-in, resell the Service, or let people outside your team use it.
- Try to break, overload, scrape, copy or get around the Service's limits or security.
10. Fees
If we charge for the Service or for each video, we will show the price before you are charged. Fees are not refundable except where the law requires, or where we choose to.
11. Changes, suspension and ending
We may change, pause or end the Service or any feature. We may suspend or end your access if you break these Terms or if your team admin removes you. You may stop using the Service at any time. Sections 3 to 8 and 11 to 16 continue after your access ends. We may update these Terms; we will change the date above and ask you to accept the new Terms before you continue.
12. No warranties
THE SERVICE AND THE OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY OUTPUT WILL MEET MLS, LEGAL OR FAIR HOUSING REQUIREMENTS.
13. Limit of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE AND OUR OWNERS, EMPLOYEES, CONTRACTORS AND SERVICE PROVIDERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, COMMISSIONS, DEALS, CLIENTS, DATA OR REPUTATION, OR FOR ANY FINE, PENALTY, MLS SANCTION, LICENSE ACTION OR FAIR HOUSING CLAIM, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE SERVICE IS LIMITED TO THE GREATER OF (A) WHAT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) US $100. Some places don't allow some of these limits, so they may not all apply to you.
14. Indemnity
You will defend, indemnify and hold harmless us and our owners, employees, contractors and service providers from any claim, demand, loss, fine, penalty, damages or cost (including reasonable lawyers' fees) that comes from Your Content, anything you publish (including Output), your breach of these Terms, or your breach of any law, MLS rule, fair housing law, or someone else's rights, including copyright in listing photos.
15. Disputes and arbitration
Please contact us first at support@webgophers.com; most problems can be fixed quickly. If we can't resolve a dispute within 30 days, you and we agree that it will be settled by binding individual arbitration under the Commercial Arbitration Rules of the American Arbitration Association, held online or in Cherokee County, Georgia, instead of in court. Either side may instead bring an individual claim in small claims court, or ask a court to stop misuse of intellectual property. You and we each give up the right to a jury trial and to take part in a class or group action. You may opt out of this section by emailing us within 30 days of first accepting these Terms.
16. General
These Terms are governed by the laws of the State of Georgia, USA, and applicable federal law, without regard to conflict-of-law rules. Any court case allowed under these Terms will be in the state or federal courts in Georgia. These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. If we don't enforce something right away, we haven't given up the right to. You may not transfer these Terms; we may transfer them as part of a merger, sale or reorganization. We aren't responsible for delays caused by things outside our reasonable control.
